Purchase, acceptance, or use of a New Era Gift Card constitutes acceptance of these terms and conditions.

 

New Era Gift Cards are issued by New Era US Retail, LLC, a New York limited liability company. These terms and conditions (the “Gift Card Terms”) apply to all digital and physical gift cards (each a “Gift Card” or collectively, “Gift Cards”) purchased, obtained, redeemed, or used in the United States. “New Era”, “we”, “us”, and “our” means [New Era US Retail, LLC]. These Gift Card Terms are “Specific Terms” under, and apply in addition to, our Terms and Conditions at https://www.neweracap.com/policies/terms-of-service and our Return & Refund Policy at https://www.neweracap.com/policies/refund-policy. If there is a conflict, these Gift Card Terms control with respect to Gift Cards. These Gift Card Terms are subject to change as provided below.

 

PURCHASE

• Gift Cards are available in denominations from $25 to $500, in $25 increments.
• Digital Gift Cards may be purchased at neweracap.com or at participating New Era retail stores and are delivered by email to the email address provided at purchase. Physical Gift Cards may be purchased only at participating New Era retail stores. You are responsible for providing a correct email address.
• Gift Cards are sold at full face value. Employee, promotional, and other discounts do not apply to the purchase of a Gift Card. Gift Cards may not be purchased with another Gift Card or store credit.
• A customer may purchase Gift Cards having an aggregate face value of no more than $2,000 in any calendar day, whether purchased in one or multiple transactions and whether purchased online, in store, or through a combination of sales channels. New Era may decline or cancel any transaction that would exceed this limit or that New Era reasonably believes is intended to avoid or circumvent this limit.
  

 

REDEMPTION

• Gift Cards may be redeemed only for eligible merchandise at neweracap.com and at participating New Era retail stores in the United States, in accordance with the applicable terms of purchase at the time of the purchase. Gift Cards cannot be redeemed at third-party retailers, stadium or venue stores, New Era pop-up or event locations, affiliate websites or stores (including ’47 Brand), or New Era websites or stores outside the United States.
• To redeem online, enter the 16-digit Gift Card number in the gift card or discount code field at checkout. To redeem in store, present the physical Gift Card or the QR code in your Gift Card email.
• Gift Cards have no expiration date. You may check your Gift Card balance by selecting “View Gift Card” in your Gift Card email, by visiting [balance check URL], or by asking an associate at a participating New Era retail store. Your receipt will show the last four digits of the Gift Card used and its remaining balance.
• No activation, service, dormancy, inactivity, or other fees are charged in connection with Gift Cards.
• Your Gift Card cannot be redeemed for cash except as required by law. Where applicable law requires that a remaining balance below a certain amount be paid in cash upon request, you may make that request at a participating New Era retail store or by contacting Customer Service at questions@neweracap.com.
• Your Gift Card cannot be returned for a refund, exchanged, resold, cancelled, or used to purchase other Gift Cards, except as required by law. Gift Card purchases are final. Gift Cards may not be used for advertising, marketing, sweepstakes, promotional, or commercial purposes without the advance written permission of New Era.
• If you return merchandise paid for in whole or in part with a Gift Card, the eligible refund will be credited back to the original Gift Card, up to the amount originally paid with that Gift Card, with any remaining refund issued to the other original form of payment, in accordance with our Return & Refund Policy.
• Your Gift Card is not a credit or debit card and is not store credit. Store credit is subject to the separate terms in our Return & Refund Policy.
• If your purchase exceeds the balance on your Gift Card, the remaining balance amount must be paid with another accepted payment method. Any unused balance remains on the Gift Card for future purchases.
• Multiple Gift Cards may be used toward a single purchase, but each Gift Card keeps its own number and balance, and Gift Card balances cannot be combined, consolidated, or transferred onto another Gift Card. Any eligible discount is applied to merchandise first, and the Gift Card is then applied to the resulting total.
• If you cannot locate your digital Gift Card email, Customer Service can resend it to the original verified email address.
• If your physical Gift Card is lost or stolen, we may, in our sole discretion and only if we can verify the original purchase and remaining balance, deactivate the original Gift Card and issue a replacement digital Gift Card for the unused balance remaining at the time of deactivation. Replacement Gift Cards are issued with a new number, and a deactivated Gift Card cannot be reactivated.
• All terms enforced except where prohibited by law.

 

FRAUD AND VIOLATION OF THESE TERMS

 

New Era will never ask you to pay for anything other than New Era merchandise with a Gift Card. Never use a Gift Card to pay taxes, bills, fines, or debts, or give a Gift Card number to someone you do not know. If someone asks you to buy a Gift Card and share the number, it is likely a scam; report it to the Federal Trade Commission at ReportFraud.ftc.gov.

 

If you violate these Gift Card Terms, or if we suspect or believe that a Gift Card was obtained, used, or applied to a purchase fraudulently, unlawfully, or otherwise in violation of these Gift Card Terms, or use any Gift Card in a manner that we suspect or believe is fraudulent, misleading, deceptive, unfair, or otherwise harmful to New Era, its affiliates, or its customers, we reserve the right, to the extent permitted by law and without notice to you, to cancel, hold, void, or refuse to accept such Gift Cards without a refund, suspend or terminate accounts, suspend or terminate the ability to use our services, cancel or limit orders, and bill alternative forms of payment.

 

RISK OF LOSS

 

Protect your Gift Card like cash. New Era is not responsible for lost, stolen, or damaged Gift Cards, or for any use of a Gift Card without your permission. Title and risk of loss for Gift Cards pass to the purchaser upon our electronic transmission of a digital Gift Card to the purchaser or the designated recipient or upon delivery of a physical Gift Card to the purchaser in store. Gift Cards must be obtained from New Era; Gift Cards obtained from unauthorized sources may be voided. You are responsible for any unlawful conduct or fraud by any third party associated with any Gift Card.

 

PROMOTIONAL GIFT CARDS

 

These Gift Card Terms apply to Gift Cards purchased for value. Any gift card, code, or credit issued for promotional purposes without payment is subject to the separate terms provided with that offer, including any expiration date stated on it.

 

LIMITATION OF LIABILITY

 

TO THE FULL EXTENT PERMISSIBLE BY LAW, WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO GIFT CARDS, INCLUDING, WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. TO THE FULL EXTENT PERMISSIBLE BY LAW, IN THE EVENT A GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, WILL BE THE REPLACEMENT OF THE UNUSED BALANCE HELD ON YOUR GIFT CARD AS SHOWN BY OUR RECORDS.

 

GOVERNING LAW AND DISPUTE RESOLUTION

 

These Gift Card Terms and any dispute arising out of or relating to a Gift Card are governed by the laws of the State of New York, without regard to its conflict-of-law principles. Except where prohibited by applicable law, any legal action arising out of or relating to a Gift Card or these Gift Card Terms must be brought exclusively in the state or federal courts located in Erie County, New York, and each party consents to the personal jurisdiction and venue of those courts.

 

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND NEW ERA WAIVE ANY RIGHT TO A TRIAL BY JURY. EACH PARTY MAY BRING A CLAIM AGAINST THE OTHER ONLY IN ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL ACTION.

 

Notwithstanding the foregoing, either party may bring an individual claim in a small-claims court of competent jurisdiction. Nothing in this section limits any rights or remedies that cannot lawfully be waived under applicable law

 

PRIVACY

 

Information collected in connection with the purchase, delivery, or redemption of a Gift Card, including purchaser and recipient email addresses, is handled in accordance with our Privacy Policy at www.neweracap.com/pages/privacy-policy.

 

CHANGES; CONTACT

 

We may update these Gift Card Terms by posting a revised version with a new “Last Updated” date. To the extent permitted by law, changes will not reduce the balance of, or add an expiration date or fees to, any Gift Card issued before the change.
